Introduction
BASE Sports Group (also referred to below as “BASE” “we”, “us”, and “our”) is a privacy conscious organization. This Privacy Notice describes how we collect, use, and share information gathered in connection with your completion of any survey, focus group, interview, study, or other activity designed to collect information that is conducted by BASE (collectively, “Surveys”) that links to or references this Privacy Notice. By responding to one of these Surveys, you agree to the use of such information in accordance with this Privacy Notice. As used in this Privacy Notice, “BASE Network” refers to one or more of BASE Sports Group, its network of partner firms and their related entities. BASE and each of its partner firms are legally separate and independent entities. All policies listed below are to cover respondents ages 13+. For terms concerning respondents younger than 13 please reference the Children’s Privacy Policy.
Information Collection
We may collect personal information about you that you provide as part of completing a Survey such as: Name, Home address, age, Any other information about you that is relevant to the survey. Personal information that is collected from you as part of a Survey may include sensitive personal information (i.e., data relating to race or ethnic origin, beliefs, gender, family makeup, etc.). We will, where necessary, obtain your explicit consent to collect and use such information.
Information Use & Selling of Information
We use your personal information that we collect in connection with a Survey for the purposes described in the Survey, or where we have a legitimate business interest in or other legal basis for, such collection and use. The personal information you submit to us may be used to verify your identity when you access a Survey, manage our relationship with you, including any of your requests, or to customize or improve our Surveys. We may also use your personal information for marketing purposes, or to send you promotional materials or communications regarding services provided by us or other members of the BASE Network that we feel may be of interest to you. We may also contact you to seek feedback on services provided by members of the BASE Network or for market or other research purposes. Your personal information may also be used to protect our rights or property and that of our users.
Disclosure of information to third parties
We may provide your personal information to other members of the BASE Network in connection with the performance of the Survey, including analysis of the data collected in the Survey. Your personal information may also be disclosed to members of the BASE Network and other third parties in order to respond to your requests or inquiries; as part of a corporate transaction (such as a sale, divestiture, reorganization, merger or acquisition); or where those parties handle information on our behalf. Personal information may also be disclosed to law enforcement, regulatory or other government agencies, or to other third parties, in each case to comply with legal, regulatory, or national security obligations or requests. By taking this survey you consent that BASE may sell the data provided for commercial purposes to established partners and clients in the BASE network.
By taking our survey, you consent that sharing and selling the data is permitted by this Privacy Notice or the Survey. When publishing data publicly, information about you that we have aggregated with information about other individuals or have otherwise made anonymous such that your identity cannot be determined may be shared by the BASE Network with third parties without restriction except to the extent otherwise set forth in the Survey. All of these disclosures may involve the transfer of personal information to countries or regions without data protection rules similar to those in effect in your area of residence. By responding to a Survey, you are consenting to the disclosures described above. Any personal information that we have referenced above under “Information collection” may be disclosed to third parties in this section for the purposes set forth herein.
Information retention
We retain personal information as necessary for the duration of the purpose outlined in this Privacy Notice. Notwithstanding the duration of the purpose, we may retain your information if necessary to comply with our legal or professional obligations, enforce our agreements, or resolve disputes.
Right to access and control your personal information
You have choices about how your personal information is collected, used and shared. Depending on the jurisdiction in which you are located, you may have the right to request that we modify, delete, or stop processing your personal information, and you may also have the right to request that we provide the following information regarding the personal information we hold about you: • The categories and/or specific pieces of personal information we collected • The categories of sources from which personal information is collected • The business or commercial purpose for collecting personal information • The categories of third parties with whom we shared personal information To exercise any of your rights under applicable law described above regarding your personal information, please complete contact [email protected]. If you are a California resident, you are entitled to request information concerning any personal information you provide to us as part of an established business relationship for personal, family, or household purposes that we disclose to nonaffiliated third parties for their direct marketing purposes. Children’s privacy protection
We understand the importance of protecting children’s online privacy. The Surveys are not designed for or intentionally targeted at children under the age of 13. It is not our policy to intentionally collect or maintain information about anyone under the age of 13. If we obtain actual knowledge that we have received such information, we will take steps to delete it.
Official Rules River City Sportsplex Survey Giveaway
NO ENTRY FEE. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THE MARKETING BREW HOLIDAY COFFEE GIFT CARD GIVEAWAY. A PAYMENT WILL NOT INCREASE THE ODDS OF WINNING. ENTRANTS MUST BE 13 YEARS OF AGE OR OLDER, AND LEGAL RESIDENTS OF THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA. VOID WHERE PROHIBITED OR RESTRICTED BY LAW OR REGULATION.
Sponsor: The sponsor of River City Sportsplex Survey Giveaway is Chesterfield County Parks and Recreation Department (“Sponsor”).
Eligibility: River City Sportsplex Survey Giveaway is only open to those who respond to the Chesterfield County Parks and Recreation Department (distributed in conjunction with tournament and event partners) first-party data form and are 13 years of age or older as of the date of entry (and if the entrant is a minor in his/her state of residence, who enter with the permission of a parent or guardian). The River City Sportsplex Survey Giveaway is open to legal residents of the fifty United States or the District of Columbia and is void where prohibited by law or regulation. Employees, independent contractors, interns, officers, directors, and agents of Sponsor, and their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members, and/or those living in the same household of each are not eligible to participate in The River City Sportsplex Survey Giveaway. The River City Sportsplex Survey Giveaway is subject to all applicable federal, state, and local laws and regulations. One reader may not win multiple prizes.
Agreement to Rules: By entering The River City Sportsplex Survey Giveaway, the entrant (“you”) agrees to comply with and abide by these official rules (“Rules”) and the decisions of the Sponsor, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the Sponsor’s decisions as final and binding as it relates to the content of The River City Sportsplex Survey Giveaway. Entrants should look solely to the Sponsor with any questions, comments or issues related to The River City Sportsplex Survey Giveaway.
Entry Period: The River City Sportsplex Survey Giveaway begins on 17 November, 2022 at 11:00 AM EDT and ends on 23 November, 2022 at 11:59PM EDT (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible.
How to Enter: The River City Sportsplex Survey Giveaway must be entered by completing the following tasks: participating at an event that takes place at River City Sportsplex, entering and submitting all metadata forms on the contest page. The only method of entry is as set forth in these Official Rules. No other method of entry will be accepted. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules of The River City Sportsplex Survey Giveaway, your submission may be disqualified at the sole discretion of the Sponsor. For the avoidance of doubt, Sponsor may not provide entrants with confirmation of The River City Sportsplex Survey Giveaway entry.
Prizes: The winner of The River City Sportsplex Survey Giveaway (the “Winner”) will receive the following prizes:
5 winners will each receive 1 Amazon gift card worth $100 to be delivered electronically.
Approximate Retail Value (“ARV”) of each prize: [$100].
Each prize is awarded “as is” with no warranty or guarantee, either express or implied. No transfer, assignment or substitution of a prize permitted, except Sponsor reserves the right to substitute prize for an item of equal or greater value in the event any component of an advertised prize is unavailable. Actual/appraised value of prizes may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution shall be permitted except for at the Sponsor’s discretion. The prize is non-transferable. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the Winner. Acceptance of the prize constitutes permission for the Sponsor to use the winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. The Sponsor will not replace any lost or stolen prizes once in winner’s possession.
Odds of Winning: The odds of winning are based upon one eligible entry that is timely received.
Winner Selection and Notification: The Winners will be selected by random drawing from among all eligible entries received on or about 31 December, 2023 under the supervision of the Sponsor. The Winner will be notified within 14 days of the winner selection. The Sponsor shall have no liability for a Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for a Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the prize within 7 days from the time award notification was sent, or fails to timely return a completed and executed Affidavit/Release as required, the prize may be forfeited, and an alternate Winner selected. Receipt of the prize offered in The River City Sportsplex Survey Giveaway by the Winner is conditioned upon compliance with any and all federal, state, and local laws and regulations. Any violation of these official rules by the Winner at the Sponsor’s sole discretion will result in the Winner’s disqualification as winner, and all privileges as Winner will be immediately terminated.
Rights Granted by the Entrant: By entering The River City Sportsplex Survey Giveaway, you understand and agree (or your parent or legal guardian understands and agrees, if you are a minor in your state of residence) that the Sponsor and anyone acting on behalf of the Sponsor or its respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about The River City Sportsplex Survey Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.
Prize Conditions. Except where prohibited by law, a potential prize winner (or the winner’s parent or legal guardian if the winner is a minor in his/her state of residence) may be required to execute an Affidavit of Eligibility, a Liability Release and a Publicity Release, and a Tax Acceptance Form (“Affidavit/Release”). Such documents must be signed and returned by the date and/or time indicated within such documents. If the documents are not signed and returned within that time, or if an entrant is found to be ineligible, or if an entrant does not comply with these Official Rules, each as determined by Sponsor in Sponsor’s sole discretion, then the potential winner will be disqualified and an alternate potential winner will be selected based on the winning criteria. Entrant waives the right to assert as a cost of winning a prize any and all costs of verification and redemption to redeem said prize and any liability which might arise from redeeming or seeking to redeem said prize. Sponsor is not responsible for fraudulent calls or emails made to entrants not by Sponsor. All entries are subject to verification prior to awarding of prizes. Eligibility, age, and claims made by prize winners also are subject to verification prior to awarding of prizes.
Taxes: All federal, state, and local taxes and other tax liabilities (including income taxes), if any, and other incidental costs or expenses not identified in these rules are the sole responsibilities of the winners. Each winner may be required to provide the Sponsor with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Entrants winning over $600 in prizes will receive an IRS form 1099 at the end of the calendar year, and a copy of such form will be filed with the IRS.
Terms and Conditions: The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend The River City Sportsplex Survey Giveaway should virus, bug, non-authorized human intervention, fraud, or other cause beyond the Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of The River City Sportsplex Survey Giveaway. In such cases, the Sponsor may select a winner(s) from eligible entries received before and/or after the action taken by the Sponsor if appropriate. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of The River City Sportsplex Survey Giveaway or website or violates these Terms & Conditions. The Sponsor has the right, in its sole discretion, to maintain the integrity of The River City Sportsplex Survey Giveaway, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by The River City Sportsplex Survey Giveaway rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of The River City Sportsplex Survey Giveaway may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.
Limitation of Liability: By entering The River City Sportsplex Survey Giveaway, you agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) unauthorized human intervention in any part of The River City Sportsplex Survey Giveaway; (iii) electronic or human error in the administration of The River City Sportsplex Survey Giveaway or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail.
Disputes: The River City Sportsplex Survey Giveaway is governed by the laws of United States and the State of California, without respect to conflict of law doctrines. By participating in The River City Sportsplex Survey Giveaway, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with The River City Sportsplex Survey Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the state or federal courts located in Los Angeles County, California, and each entrant accepts and submits to the personal jurisdiction of such courts with respect to any legal actions, suits or proceedings arising out of or related to The River City Sportsplex Survey Giveaway. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and hereby waive all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than actual out-of-pocket expenses (i.e. costs associated with entering The River City Sportsplex Survey Giveaway). You further waive all rights to have damages multiplied or increased.
Force Majeure. Without limiting any other provision in these Official Rules, in the event that any of The River City Sportsplex Survey Giveaway activities or the Sponsor’s operations or activities are affected, as determined by the Sponsor, in its sole discretion, including, without limitation, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, pandemic, epidemic or public health crisis, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any law, rule, regulation, order or other action adopted or taken by any governmental, federal, state or local government authority, or any other cause, whether or not specifically mentioned above, subject to any governmental approval that may be required, the Sponsor shall have the right to modify, suspend, or terminate The River City Sportsplex Survey Giveaway, and no releasees shall be responsible or liable to any entrant or prize winner or any person claiming through such entrant or prize winner for failure to supply the prize or any part thereof. The Sponsor is not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s e-mail account to receive e-mail messages.
